Dacă aş fi iar copil în primii ani de şcoală şi cineva m-ar întreba „Ce vrei tu să te faci când o să fii mare?“, aş răspunde scurt şi fără să stau pe gânduri: ţigan! De ce? Pentru că, dacă aş face parte din această minoritate, şi fiind vorba de o minoritate, din start aş avea niscai avantaje, de-a lungul vieţii aş trece prin probleme asemenea unei gâşte prin apă. Când mi-a fost vremea, visam să mă fac medic, să fiu militar de carieră, dar m-am răzgândit pe… parcurs. Acum, datorită bunului simţ şi şcolilor urmate, stau cu chirie şi sunt dator la bănci. Nu de multe ori am asistat la scene în mijloacele de transport în comun, în care eu, ca reprezentant al „rasei majoritare“, m-am simţit victimă a unei agresiuni rasiale. În timp ce dacă un elev de câteva clase sau bunica acestuia nu compostau bine tichetul de călătorie era ţintuiţi într-un colţ, cu echipa de control făcând zid în faţa sa pentru a nu coborî din maşină fără să plătească, alta era situaţia cu minoritarii. În cel mai fericit caz erau coborâţi la prima staţie, asta dacă acceptau indicaţiile şi nu vroiau să coboare decât acolo unde aveau ei treabă. De amendă nici vorbă, „că şi aşa nu o plătesc“. Deci, ca ţigan aş avea parte de gratuitate în mijloacele de transport în comun. Tot aici pot să ţip, să înjur, să scuip şi să pun maneaua să urle la telefon, pentru că nimeni nu mi-ar zice nimic. Nu că aş arăta eu fioros, da’ am în spate un renume al înaintaşilor mei, care cam taie cheful multora de a comenta. Din acelaşi motiv pot face scandal în bloc şi să dau petreceri cu boxele scoase pe geam. Chiar dacă îşi face curaj careva şi mă reclamă, poliţiştii mă… înţelege (nu este o greşeală gramaticală, ci doar o exprimare neaoş ţigănească). În urmă cu ceva timp, vecinii de la blocul de vizavi, minoritari şi musulmani, au pus-o de un botez, cu formaţie şi tot tacâmul pe trotuar, de parcă erau singuri în deşert. Pun mâna pe telefon şi sun la secţie, reclam „tulburarea liniştii şi ordinii publice“. Spre mirarea mea, după câteva minute, priveam pe după perdea apariţia unui echipaj de Poliţie. Spre stupefacţia mea, când bravii apărători ai legii au plecat, în urma lor chelălăiala din boxe a pornit mai abitir. Sun iar la secţie. Prezint situaţia, iar ofiţerul de serviciu îmi spune. „Au un botez, domle’. Au fost băieţii şi au vorbit cu ei, o să ţină jumătate de oră şi o să se oprească. Nu avem ce să le facem, ştiţi doar şi dumneavoastră cum sunt ăştia…“ (!?!) Atunci mi-am dorit pentru prima dată să fiu ţigan. Analizând dorinţa mea, am descoperit şi alte avantaje. Aş putea să stau în centru, într-o casă naţionalizată, la care chiria este modică, sau pe care să o ocup abuziv, că tot ar trece câţiva ani până m-ar da cineva afară. Pot să fac bişniţă cu te miri ce sau alte găinării, că nu o să păţesc mare lucru. Nici să mă aresteze nu ar avea cum, în condiţiile în care nu au cum să completeze mandatul. Ce serie şi număr de buletin să treacă acolo, când nicio pirandă nu-şi înregistrează puradelul la starea civilă? Vreau să fiu ţigan ca toată familia mea să locuiască într-un palat cu turnuleţe şi merţan la poartă, iar statul să-mi dea ajutoare sociale şi subvenţii. Pot să mă duc pe afară. Din ţară, nu din casă. Îmi trântesc un cort unde vreau eu, iar apoi să se roage ăia de mine să mă întorc în Romanica, başca să îmi dea şi ceva bănuţi de buzunar. Când adun destul, îmi trântesc ditamai palatul, fără acte şi autorizaţii şi nici impozit nu o să plătesc la stat. Vine Poliţia şi mă saltă? Nicio problemă. Le fac reclamaţii şi fac scandal, că eu, un biet minoritar, am fost abuzat şi mi-au fost încălcate drepturile, pe când ei, nişte amărâţi care muncesc pe doi lei, au o grămadă de obligaţii pe care nu sunt în stare să le îndeplinească…

Provident - cea mai activă şi mai hrăpăreaţă firmă de cămătari cu acte în regulă din România

Am imprumutat de la Provident 1500lei chiar de sarbatori. Nu aveam ce pune pe masa si nici Mos Craciun nu venea la fetita mea. De 6 saptamani nu am mai platit nici o rata. Sunt disperata ca nu am cum sa restitui banii, dintr-un salariu de 540 de lei abia am de mancare. Vreau sa termin o data ca m-am saturat de telefoane si vizite la domiciliu. Nici afara nu pot iesi cu fetita ca agentul ma urmareste. Cand vin de la servici si ea (fetita) vrea la plimbare simt ca innebunesc. Nu cred ca cineva imprumuta bani pt tel. si LCD-uri, ci pt. a avea ce pune pe masa. Eram disperata cand am facut imprumutul. Acum regret pt ca nu am cum sa-l restitui.

Aceasta este povestea uneia dintre “clientele” Provident, cel mai mare camatar din Romania

Una dintre clauzele contractuale impuse de Provident este: Putem da buzna oricând peste tine, ca să-ţi cerem banii!

- În contractul pe care clienţii „Provident” îl semnează „cu ochii închişi”, se menţionează că orice angajat poate vizita clientul fără vreo notificare prealabilă

- Această vizită „poate fi refuzată sau amânată numai din motive întemeiate”.

- Practicile de tip miliţienesc „legalizate” prin contractele „Provident” dau dreptul angajaţilor firmei de a-şi teroriza clienţii care au dificultăţi financiare

- Clienţii pot specula o eroare a contractului: agenţii „Provident” nu sunt angajaţi, iar clauza respectivă se referă exclusiv la angajaţi

- „M-am săturat de telefoane şi vizite la domiciliu. Nici afară nu pot ieşi cu fetiţa, că agentul mă urmăreşte”, se plânge un clienta „Provident” care a întârziat cu plata ratelor.

La titlul de „cea mai activă şi mai hrăpăreaţă firmă de cămătari cu acte în regulă din România” poate candida cu mari şanse de succes firma „Provident Financial România IFN” (cunoscută ca „Provident”). Sumele pe care nefericiţii clienţi trebuie să le ramburseze ajung să se apropie de dublul împrumutului angajat, în condiţiile în care perioada maximă de creditare este de 56 de săptămâni.

Deşi activează de ani buni, instituţiile abilitate nu au avut curiozitatea de a analiza contractele încheiate de „Provident”, pentru că altfel ar fi sesizat atât lipsa unor clauze obligatorii, cât şi prezenţa altora care se pot încadra la „clauze abuzive”.

Un exemplu al extraordinarului tupeu „Provident”, dar şi al disperării şi naivităţii de care dau dovadă clienţii acestor cămătari cu acte în regulă, este Articolul 12 din contract, unde se spune:

„Clientul acceptă că orice angajat al Provident poate vizita Clientul la adresa indicată mai sus pentru a discuta orice problemă în legătură cu Contractul de Credit fără vreo notificare prealabilă. Această vizită nu va prejudicia dreptul Clientului la intimitate şi poate fi refuzată sau amânată numai din motive întemeiate”.

Drepturile pe care şi le arogă cămătarii „Provident” sunt exact cele pe care le aveau miliţienii şi securiştii, care oricând puteau să te viziteze acasă „fără vreo notificare prealabilă”. Singura diferenţă este că pentru vizitele miliţienilor nu îţi dădeai acordul scris….

Sărind peste faptul că „mai sus” nu există nici o adresă indicată, aceasta fiind trecută pe verso, remarcabil este faptul că „orice angajat al Provident poate vizita Clientul”, nu numai persoana care a încheiat contractul, această clauză fiind special menţionată pentru ca, în cazul unor întârzieri, clientul să poată fi şicanat de diverşi indivizi.

Numai că aici există o problemă pe care „autorii” contractului nu au semnalat-o: agenţii „Provident” nu au calitate de angajaţi „Provident” ceea ce înseamnă, conform contractului, că ei recurg la un abuz atunci când „vizitează” clientul, iar clientul ar putea fi pe deplin îndreptăţit „să le dea cu flit”.

Iar faptul că aceşti agenţi nu sunt angajaţi nu este doar o bănuială, ci este scris tot în contract, chiar la articolul 1: „Pentru a evita orice confuzie agenţii nu sunt angajaţi ai Provident”.
